How can we afford to offer such an extensive guarantee?
We have invested a lot of hard work on knowing our bloodlines, and genetics, as well as by health testing each of our breeding dogs we know what to expect and how to improve each generation.
We do not however, claim to breed perfect dogs. There will inevitably be genetics we cannot yet test for. Due to this there may be genetic conditions that may arise which is why we offer a Lifetime Genetic Health Guarantee.
PUPPY PLACEMENT AGREEMENT
FOUNDATION
Placement is not a transaction. It is a long-term responsibility. Every decision is made in the best interest of the dog, not convenience, timing, or preference.
PAYMENT TERMS
Buyer acknowledges that all fees are clearly disclosed prior to payment and are agreed to voluntarily. Buyer understands that Application Processing Fees and Reservation Fees compensate Seller for time, evaluation, opportunity cost, and removal of the puppy from active availability.
Buyer agrees not to initiate chargebacks, payment disputes, or reversals for any non-refundable fee. Any such action constitutes a material breach of this Agreement, and Buyer agrees to be responsible for all costs incurred by Seller in responding to or recovering such funds, including but not limited to administrative time, collection costs, chargeback fees, and attorney fees.
Application Processing Fee
A non-refundable Application Processing Fee of $150 is required to initiate the approval process.
This fee must be submitted prior to any in-person visits or puppy meetings and covers time, screening, and placement coordination.
Submission of an application does not guarantee approval, placement, or availability.
Reservation Fee
If Buyer is approved and verbally commits to a specific puppy or dog in person, a non-refundable Reservation Fee of $350.00 is required to secure placement. The puppy or dog is not considered reserved until this fee is received. The Reservation Fee is applied toward the final Purchase Price.
The Reservation Fee is non-refundable but may be transferred one time only to a future puppy or dog from Seller’s program, subject to Seller approval. Transferred fees must be used within 12 months of the original payment date and may not be reassigned, sold, or transferred to another individual.
Transfer of the Reservation Fee does not guarantee availability, selection priority, or timeline and remains subject to Seller’s placement decisions.
Failure to complete payment, pickup, or agreed arrangements within the specified timeframe will be considered abandonment. All fees remain non-refundable, and Seller retains the right to relist the puppy or dog.
PURCHASE PRICE
The full purchase price is agreed upon with the remaining balance due in full prior to delivery or at time of pickup.
All shipping, handling, medical, rehabilitation, transportation, and related costs are the responsibility of Buyer.
If Buyer fails to complete payment within the agreed timeframe, misses scheduled appointments without reasonable notice, or delays pickup or transport, Seller may cancel the sale. All fees paid will be forfeited and Seller retains full rights to the puppy or dog.
RIGHT TO REFUSE SALE
Seller retains full discretion in all placement decisions. Payment of any fee does not guarantee approval, placement, or transfer of ownership.
Seller reserves the right to refuse or cancel any sale at any time prior to transfer of ownership if Buyer is deemed unfit, unreliable, unprepared, or if placement is no longer in the best interest of the dog.
If this occurs, Seller may issue a refund at their discretion minus any incurred costs.
INITIAL 72 HOUR HEALTH WINDOW
Buyer must have the puppy examined by a licensed veterinarian within 72 hours of receipt.
If the puppy is found to be unfit for purchase due to a verifiable health condition, Buyer may return the puppy for replacement or refund at Seller’s discretion.
If the puppy is returned for any reason other than veterinarian-certified health condition, Buyer is responsible for all transportation costs. Seller will have the puppy examined and quarantined for no less than 8 days and up to 14 days or longer if required.
If deemed healthy, the puppy will be placed for resale at current market value, which may be lower than the original purchase price. Once resold, Buyer will be refunded the resale value minus all incurred costs including but not limited to quarantine fees, veterinary care, training, transportation, administrative costs, Application Processing Fee, and Reservation Fee.
RETURN AFTER TRANSFER OF POSSESSION
Buyer acknowledges this is a private breeder placement program and not a retail or consumer sales model. Seller does not offer convenience-based returns, exchanges, or satisfaction guarantees, and standard consumer expectations do not apply. Buyer further acknowledges that emotional dissatisfaction, bonding challenges, lifestyle incompatibility, or unmet expectations do not constitute valid grounds for refund, reversal, dispute, or chargeback.
Seller is not a retail entity and does not operate on a return for convenience model.
If Buyer is unable or unwilling to keep the dog at any time, Buyer must notify Seller immediately.
The dog must be returned to Seller or rehomed only with Seller’s prior written approval. The dog may not be sold, transferred, surrendered, brokered, or rehomed without Seller’s consent.
Failure to comply constitutes a material breach of contract and may result in reclaim of the dog without refund.
Refunds are not guaranteed.
If Seller successfully places the returned dog, Buyer may receive resale value minus all associated costs. Market value may be lower than original purchase price.
In lieu of refund, Buyer may request credit toward a future dog, subject to Seller approval and based on current market value at time of return.
All transportation and associated costs are the responsibility of Buyer.
Seller retains full discretion over placement timeline and future home.
HEALTH
Seller certifies the puppy or dog is healthy at time of placement and current on age-appropriate vaccinations.
Due to the nature of raising puppies, exposure to parasites or environmental stressors may occur and may activate under stress of transition.
If medication is provided, Buyer is responsible for completing all treatment instructions.
Seller provides all health records at time of placement.
Seller is not liable for zoonotic diseases after transfer of possession.
HEALTH EXCLUSIONS
Seller does not warranty against conditions caused by stress, environmental changes, or exposure after leaving Seller’s care. This includes but is not limited to hypoglycemia, parasites, giardia, viral or bacterial infections, parvovirus, coccidiosis, distemper, mycoplasma, brucellosis, herpes, or coronavirus.
SPAY AND NEUTER REQUIREMENT
Buyer agrees to delay spay or neuter until a minimum of 24 months of age.
Buyer must provide veterinary documentation including microchip verification within 30 days after completion. Failure to provide documentation voids the health guarantee.
Seller is not responsible for complications resulting from failure to follow this requirement.
LIFETIME GENETIC HEALTH GUARANTEE
If the dog is diagnosed with a verifiable life-threatening genetic defect, Buyer must notify Seller within 7 days and provide all veterinary documentation.
Seller reserves the right to confirm diagnosis through a veterinarian of Seller’s choice.
If confirmed, the dog must be returned for replacement of equal value or Buyer may receive credit toward another dog at Seller’s discretion.
In the event of death, a full necropsy is required. Failure to provide necropsy results voids any claim.
Seller does not guarantee adult size, confirmation, temperament, or breeding capability.
CARE AND OWNERSHIP
Buyer assumes full responsibility for all care decisions after transfer of possession.
Buyer agrees to provide proper nutrition, veterinary care, structure, and a safe environment.
Behavior, temperament, and adjustment are influenced by environment and training. Seller is not responsible for behavioral outcomes.
Failure to provide proper care voids all guarantees.
BREEDING RESTRICTIONS
Dog is sold as a companion unless otherwise agreed in writing.
Unauthorized breeding constitutes a material and intentional breach of contract. Seller reserves the right to reclaim the dog and pursue legal action including damages, recovery of offspring, and enforcement costs.
RECLAIM RIGHTS
If Buyer is found to be neglecting or abusing the dog, Seller retains the immediate right to reclaim the dog without refund.
If the dog is transferred or rehomed without approval, Seller retains the right to reclaim the dog.
NO RESALE OR SURRENDER
Under no circumstances may the dog be sold, surrendered, placed in a rescue, brokered, or transferred without Seller approval.
Buyer must keep all contact information current.
BUYER ACKNOWLEDGMENT
Buyer confirms they have had the opportunity to ask questions and seek independent advice.
Buyer acknowledges they are not relying on any statements not contained in this Agreement.
Buyer affirms they are prepared for long-term ownership.
NORMAL ADJUSTMENT
Buyer understands that adjustment behaviors including whining, barking, anxiety, and transition challenges are normal and are not grounds for return, refund, or dispute.
NON-DISPARAGEMENT
This clause does not restrict truthful statements made in legal proceedings but applies to knowingly false, misleading, or harmful public statements. Buyer agrees not to make false, misleading, or defamatory statements regarding Seller, program, or dogs.
LIMITATION OF LIABILITY
Seller’s liability under this Agreement is limited to the remedies expressly stated herein. Under no circumstances shall Seller be liable for incidental, consequential, or emotional damages, including but not limited to veterinary costs, training costs, travel expenses, or loss of companionship.
ATTORNEY FEES
In any action to enforce this Agreement, the prevailing party is entitled to reasonable attorney fees and costs.
MEDIATION
All disputes must first be submitted to mediation prior to legal action.
GOVERNING LAW
This Agreement is governed by the laws of the State of Utah. All disputes shall be handled in Box Elder County, Utah.
FINAL EXECUTION
Buyer acknowledges that no verbal statements, representations, or assurances outside of this written Agreement are binding. This Agreement represents the entire understanding between Buyer and Seller and supersedes all prior discussions or agreements.
